These Terms and Conditions govern the services provided by Van der Merwe Media ("Photographer") and the use of this website. By booking any photography service or using this website, you agree to comply with these terms.

1. Scope of Work

The Photographer agrees to provide photography services as per the agreed-upon package and specifications outlined in the booking confirmation or invoice.

2. Booking and Payment

A non-refundable retainer fee is required to secure your booking. The remaining balance must be paid on or before the scheduled shoot date. Failure to complete payment may result in the cancellation of services.

3. Travel Fees

The first 20km from Kuilsriver is free. Thereafter, a travel fee of R4.00 per km applies. Accommodation and additional travel costs (if applicable) will be discussed and agreed upon in writing before the booking.

4. Turnaround Time

Edited images will be delivered within 2 to 4 weeks for standard sessions and 4 to 6 weeks for wedding photography. During peak seasons, delivery may take 6 to 8 weeks. The Photographer will communicate any unforeseen delays promptly.

5. Image Delivery & RAW Files

High-resolution edited images will be provided digitally. RAW or unedited images are not included but may be purchased at an additional cost.

6. Retouching and Editing

Standard retouching is included in the package. Advanced editing (e.g., body reshaping, object removal) is available upon request and may incur additional charges.

7. Ownership & Usage Rights

All photographs remain the property of Van der Merwe Media. Clients receive personal use rights, allowing them to print and share images for non-commercial purposes. Clients may not sell, distribute, or alter the images without written permission. If images are published (e.g., magazines, blogs, or online), credit must be given to Van der Merwe Media.

8. Privacy & POPI Act Compliance

The Photographer complies with the Protection of Personal Information Act (POPIA) to protect client data. Client images will not be used for marketing or promotional purposes without explicit consent. Clients can request the removal of images from online platforms at any time.

9. Cancellations & Refunds

Retainer fees are non-refundable. Cancellations made less than 7 days before the session will forfeit all payments. Rescheduling is allowed with a minimum of 48 hours' notice, subject to availability.

10. Liability

The Photographer will take all reasonable precautions to deliver high-quality images. In the event of unforeseen circumstances (e.g., equipment failure, illness, extreme weather), liability is limited to a full refund of payments made. The Photographer is not responsible for lost or damaged images due to technical malfunctions beyond their control.

11. Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond their control, including but not limited to natural disasters, strikes, and government restrictions.

12. Agreement

By booking a session or using this website, the Client acknowledges and agrees to these Terms and Conditions.
